To use the ePSM website you must provide a valid user name, password, and e-mail address. The information provided must be complete and accurate. If you are a business, government or non-profit, the account registrant must have the authority to bind the entity to this agreement. Your account may have the ability to create additional user logins that are tied to your account; usernames created in this way must not violate any third party right or be obscene or objectionable.

ACCOUNT SECURITY

You are responsible for all activity that occurs from your account. This includes any activity or action performed by an unauthorized user. Account access is granted specifically to the person bound to the e-mail address the account was registered under. You must safeguard your account access information. If you are using a computer that other persons have access to, you must log out of the ePSM website when you are finished using our service. If you become aware of unauthorized access to your account, notify ePSM immediately by phone at (+1) 540-941-2001.

PRIVACY POLICY

Your privacy rights are written in our Privacy Policy which is a part of this Agreement. Please read the Privacy Policy carefully to learn about what information we collect about you, what we use that information for, and who we share that information with.

LICENSING

As long as your account is enabled, ePSM authorizes you a limited, non-exclusive license to utilize the ePSM website application for your purposes. This license is applicable only to you and may not be given to anyone else.

Except as permitted by ePSM in writing, you will not reproduce, redistribute, sell, decompile, reverse engineer, or disassemble the ePSM website. You also agree to refrain from interfering with or damaging the ePSM website. All rights not specifically granted by ePSM are reserved.

SUBSCRIPTIONS

Refunds – Users who purchase annual subscriptions have fourteen (14) days after their purchase to cancel and receive a full refund. After the refund period is over, all sales are final and all fees paid are non-refundable. Under no circumstances will ePSM be required to issue a refund.

Renewals – ePSM reserves the right to deny subscriptions, renewals, and any other purchases for any reason.

Retires – When your ePSM subscription retires, ePSM will hold onto your data for a guaranteed period of thirty (30) days. After this allowance period, ePSM is not responsible for any data loss or account deletion that may occur.

TERMINATION

Your account can be removed from our service by calling (+1) 540-941-2001. ePSM reserves the right to delete your account after thirty (30) days has elapsed from your account subscription renewal date if the account was not renewed. ePSM will not be held responsible for any data loss that occurs to your account for any reason.

CODE OF CONDUCT

By using the ePSM website, you agree to refrain from:

• Harassing other users of the service
• Distributing “spam”
• Collecting information about other users of the service
• Advertising or soliciting

ePSM has the right to monitor all conduct and content submitted to the ePSM website.

DISCLAIMER

ePSM reserves the right to modify and change the ePSM website. You will provide your own access to the website. ePSM will not screen the data submitted to it. ePSM offers itself “as is” and “as available.” You use the ePSM website at your own risk. ePSM disclaims any and all warranties express or implied. ePSM makes no warranty that the service will be uninterrupted or error free; That any data submitted to ePSM will be stored or made available; That ePSM meets your business needs; That ePSM will continue to offer or support any feature of the website;

To the fullest extent permitted by law: ePSM shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, or other tangible losses and that ePSM total liability to the account holder shall not exceed the amounts paid by you to ePSM over the twelve (12) months preceding your claim.

PROVISIONS

This Agreement shall be governed by the laws of the State of Virginia, United States of America without regard to principles of conflicts of law. Any action arising out of or relating to this Agreement or your use of ePSM must be commenced in the state or federal courts located in Virginia. This agreement may not be modified except by a revised Terms and Conditions posted by ePSM on the ePSM website.
